Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the GuidePro service ("Service"), operated by M P Umagiliya, an individual sole proprietor trading as "GuidePro" ("we", "us", "our"). By accessing or continuing to use the Service, you agree to be bound by these Terms.

1. The Service

GuidePro is a software-as-a-service tool that helps tour guides manage tours, companies, commissions, expenses, settlements, and related records.

2. Eligibility & Account

You must be of legal age and have authority to enter these Terms. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and keep it current.

3. Acceptable Use

You must not misuse the Service. You agree you will not:

  • use the Service for unlawful, fraudulent, or abusive purposes;
  • upload spam, malware, or infringing content;
  • infringe the intellectual property or privacy rights of others;
  • attempt to interfere with, probe, scrape, or breach the security of the Service;
  • reverse engineer, resell, or redistribute the Service or its parts.

4. Intellectual Property

The Service, including its software, branding, and documentation, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. You retain ownership of the content you upload; you grant us a limited licence to host and process that content solely to provide the Service to you.

5. Service Availability

We strive to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or secure at all times. To the fullest extent permitted by law, all implied warranties (including merchantability and fitness for a particular purpose) are disclaimed.

6. Payments, Billing & Subscriptions

Payments, billing, taxes, cancellations, and refund processing are handled by our reseller, Paddle. Please review the Paddle Buyer Terms for the commercial terms governing your purchase. Subscriptions renew automatically for the chosen interval until cancelled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Suspension & Termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your data after a reasonable export window.

8. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

9. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

10. Governing Law

These Terms are governed by the laws of Sri Lanka. Disputes shall be submitted to the competent courts of Sri Lanka, without prejudice to mandatory consumer protections in your country of residence.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
